 Il sistema di attribuzione e di accertamento giudiziale dello stato, unico, di figlio

Abstract [It]: La riforma avviata dalla legge n. 219 del 2012 e completata dal d.lgs. n. 154 del 2013, pur incentrata sul principio di unicità dello stato giuridico di figlio, non ha comportato l’unificazione delle modalità di attribuzione e di accertamento giudiziale dello stato che continuano ad essere diverse, a seconda della presenza o meno del matrimonio tra i genitori. Il contributo riflette su questo profilo alla ricerca di una possibile chiave di lettura.

 

Title: The method of attribution and judicial assessment of the legal status of the child. Reflections after ten years from the reform of the right of filiation and perspectives de iure condendo in the light of the ECtHR jurisprudence

Abstract [En]: The reform initiated by the law n. 219 of 2012 and completed by the legislative decree no. 154 of 2013, although focused on the principle of uniqueness of the legal status of the child, did not lead to the unification of the methods of attribution and judicial assessment of that status, which continue to be different, depending on whether or not the parents are married. The contribution reflects on this profile in search of a possible interpretation.

Sommario: 1. L’unicità dello stato giuridico di figlio e la persistente differenziazione delle modalità di attribuzione dello stato di figlio nel o fuori del matrimonio. 2. Il ruolo privilegiato della volontà materna nell’attribuzione dello stato di figlio. 3. L’accertamento della paternità e l’inviolabilità della famiglia nucleare fondata sul matrimonio. 4. Conclusioni. La “rinnovata” dimensione istituzionale del matrimonio.
