 La questione dei cognomi e ciò che ci sta attorno

Abstract [It]: Come la storia ci insegna, l’assegnazione del cognome è un fatto politico. È il legislatore che deve farsene carico, anche perché nella disciplina di tutto ciò che riguarda la famiglia non è mai la Corte costituzionale a guidare il carro. Ma negli ultimi tempi la paralisi del legislatore su ogni questione “eticamente sensibile” costringe la Corte a inventarsi soluzioni nuove. Ma non è così che può reggere il sistema.

 

Title: Conclusions. The issue of surnames and what lies around it

Abstract [En]: As history teaches us, assigning a surname is a political matter. It is the legislature that has to deal with it, not least because in regulating everything related to the family, it is never the Constitutional Court that drives the bandwagon. But in recent times the paralysis of the legislature on every “ethically sensitive” issue forces the Court to invent new solutions. But this is not how the system can hold up.
