La figura del Segretario comunale dopo la sentenza n. 23/2019

Abstract [It]: Mai come prima della sentenza n. 23 del 22 febbraio 2019 la giurisprudenza costituzionale si era trovata a ricostruire i complessi profili della poliedrica figura del Segretario comunale e le sue relazioni con il meccanismo dello spoils system. Con il presente lavoro si vuole offrire un’essenziale chiave di lettura nella complessità delle argomentazioni esposte nel Considerato in diritto della decisione della Consulta: ancorché sviluppando i termini del ragionamento fatto dal Collegio il presente contributo perviene a soluzioni del tutto differenti, ravvisando nel ruolo e nelle funzioni del Segretario comunale una figura necessariamente espressione della ‘effettiva’ garanzia costituzionale del principio di legalità, di trasparenza, imparzialità e buon andamento delle Pubbliche Amministrazioni comunali e delle discendenti attività di ‘amministrazione attiva’. Da qui l’impossibilità di poter ammettere la legittima applicazione dello spoils system anche alla figura del Segretario comunale.

Abstract [En]: Never before judgment no. 23 of February 22^nd 2019 constitutional jurisprudence had found itself reconstructing the complex features of the multifaceted figure of the Municipal Secretary and its relations with the Spoils System mechanism. This work aims to provide the reader with a key to interpreting the arguments set forth in the grounds for the decision: although starting from and developing the terms of the reasoning Court’s this contribution comes to utterly different conclusions, recognizing the role and functions of the Municipal Secretary as intrinsic expression of an ‘effective’ guarantee of the legality, transparence, impartiality and good performance principles that should govern municipal administrations and the related activities of “active administration”. Hence the impossibility of admitting the spoils system also for the figure of the Municipal secretary.
