 Il diritto di accesso del consigliere comunale

Abstract [It]: Secondo un consolidato orientamento giurisprudenziale i consiglieri comunali possono accedere a tutti gli atti utili all'espletamento delle loro funzioni, non incontrando neppure alcuna limitazione derivante dalla eventuale natura riservata delle informazioni, in quanto essi sono tenuti al segreto nei casi specificamente determinati dalla legge. Il presente contributo approfondisce il quadro normativo e giurisprudenziale sul diritto di accesso del consigliere comunale, focalizzando, in particolare, il segreto d’ufficio al quale è vincolato.

 

Abstract [En]: According to a well-established jurisprudence, city councillors can access all the acts useful for the performance of their duties, without encountering any limitation deriving from the possible confidential nature of the information, they shall be kept secret in cases specifically determined by law. This contribution deepens the regulatory and jurisprudential framework on the right of access of the municipal councillor, focusing, in particular, the professional secrecy to which he is bound
