Riflessioni su elezione diretta dei sindaci e limitazione al numero di mandati consecutivi, a partire dalla giurisprudenza costituzionale recente

Abstract [It]: Il presente contributo intende esaminare la sent. n. 60 del 2023 e la sent. n. 196 del 2024, con cui la Corte costituzionale si è pronunciata in merito a delle questioni concernenti la limitazione al numero di mandati consecutivi per i sindaci. Anche se è la stessa sent. n. 196 del 2024 a richiamare la sent. n. 60 del 2023, si ritiene che il giudice costituzionale, nelle due decisioni, abbia seguito percorsi argomentativi in parte diversi. Saranno allora successivamente analizzati i passaggi salienti delle due decisioni, utili per ragionare sull’evoluzione e sul rendimento della normativa concernente l’elezione dei sindaci. Le scelte normative operate vanno inoltre calate nello specifico contesto attuale, in cui si assiste ad una tendenza al rafforzamento degli esecutivi a tutti i livelli di governo. Ci si interroga infine sull’opportunità e sulla effettiva possibilità di una revisione complessiva della disciplina.

Title: Considerations on direct election of mayors and limits on consecutive terms from the most recent constitutional case-law

Abstract [En]: This paper examines Sentence No. 60 of 2023 and Sentence No. 196 of 2024, in which the Constitutional Court ruled on the limitation of mayors’ consecutive terms of office. Although Sentence No. 196 of 2024 refers to Sentence No. 60 of 2023, it is believed that the Constitutional Court followed different lines of reasoning in the two decisions. The following analysis of the most important passages of the two decisions is useful for understanding the evolution and performance of legislation on the election of mayors. Furthermore, the normative choices must be understood within the context of the present, where there is a tendency to strengthen the executive branch at all levels of government. This raises the question of whether a systemic revision of the discipline is truly possible.
