Tracciare l’influenza: l’ 'impronta esecutiva' in Germania tra trasparenza delle lobbies e funzione normativa del Governo

Abstract [It]: Il saggio si concentra sull’analisi formale e della prassi della c.d. “impronta esecutiva” (exekutiver Fußabdruck) inserita nel Regolamento comune dei Ministeri federali tedeschi nel 2024. Una sorta di “orma” del passaggio dei gruppi di pressione sugli atti dell’esecutivo. L’analisi offre una prima verifica teorica e applicativa: a livello federale emergono scarsa frequenza di pubblicazioni, vaghezza dei criteri di “significatività” e assenza di un presidio di enforcement; nei Länder la prassi risulta più strutturata grazie a formati standardizzati. Il contributo discute inoltre la fortuna dell’istituto nel quadro comparato e le implicazioni costituzionali della dimensione digitale: l’impronta abilita controllabilità e partecipazione, ma non intercetta il digital lobbying in senso proprio così come le influenze algoritmiche a monte dell’agenda-setting.

Title: Tracing Influence: The ‘Executive Footprint’ in Germany Between Lobbying Transparency and the Normative Role of the Government

Abstract [En]: The essay focuses on the formal framework and practical operation of the so-called “executive footprint” (exekutiver Fußabdruck), introduced into the Common Rules of Procedure of the German federal ministries (GGO) in 2024. The mechanism functions as a “trace” of interest-group influence on executive instruments, covering both draft bills and their final texts. The analysis offers an initial theoretical and empirical assessment: at the federal level, publication is infrequent, the criteria for “significance” remain vague, and no enforcement mechanism is in place; by contrast, practice in the Länder is more structured thanks to standardized formats. The contribution also examines the comparative framework and the constitutional implications of the digital dimension: while the footprint enhances verifiability and participation, it does not capture “digital lobbying” in the strict sense nor the algorithmic influences operating upstream in the agenda-setting phase.
