 Rileggendo E.-W. Böckenförde su potere costituente e interpretazione costituzionale

Abstract [It]: A ben vedere, l’etica pubblica costituzionale non è semplicemente qualcosa di “presupposto”, solo di preesistente, perché invece essa è anche il frutto di una maturazione sociale cui contribuisce pure lo stesso testo giuridico della Carta, per la sua forza orientativa, e perché la Costituzione non è solo un atto (puntuale nel tempo), ma un processo (storico). Per questo forse non è incolmabile il fossato che sembra dividere – sul piano del “metodo interpretativo” – le posizioni di E. -W. Böckenförde e P. Häberle.

Abstract [En]: At a closer look, constitutional ethics is not simply something “presupposed”, only pre-existing, because instead it is also the result of a social maturation to which the text of the Constitution also contributes, due to its guiding force, and because the Constitution is not just an act (timely), but a (historical) process.  And for this reason, perhaps, the gap that seems to divide E. -W. Böckenförde and P. Häberle positions, on the “interpretative method”, cannot be bridged.
