 '… de' remi facemmo ali al folle volo': i rischi dell’imprudenza nei lavori del Comitato per la determinazione dei Livelli essenziali delle prestazioni

Abstract [It]: I lavori del Comitato tecnico-scientifico con funzioni istruttorie per la individuazione dei Livelli essenziali delle prestazioni (LEP) sono segnati da crescenti fronti divisivi, che ne pongono a repentaglio l’esito. Fra questi si segnala il nodo critico riguardante l’eventuale destrutturazione del sistema delle fonti a vantaggio di una nuova categoria normativa, autonoma ed esterna all’ordinamento. Il lavoro manifesta la necessità che l’attività istruttoria del Comitato sia riferita al realismo formale (rispetto del sistema costituzionale delle fonti) e sostanziale (rispetto dell’equilibrio costituzionale sotteso al regionalismo asimmetrico).

 

Abstract [En]: The work of the Technical-Scientific Committee with preparatory functions for the identification of the Basic Levels of Benefits (BLB) is marked by increasing divisive positions that jeopardise its outcome. One of them is the critical issue concerning the possible deconstruction of the system of sources of law in favour of a new normative category, autonomous and external to the system. This work points out the need for the Committee's activity to be informed by formal realism (respect for the constitutional system of sources of law) and substantial realism (respect for the constitutional balance underlying asymmetrical regionalism).
