Abstract [En]: The European legal system devotes specific provisions to the condition of insularity, both as regards the special regime of the outermost regions (349 and 355 TFEU, all of which are island regions except French Guiana), but also for European island regions. A growing consideration that connects to the current paths of constitutionalisation (in Italy, which introduced the sixth paragraph of Art. 119 Cost., which is linked to those already defined in Spain and Portugal, and to the path started in France with the proposal drawn up by Corsica). The study aims to analyse the evolution of European law up to the provisions of art. 174 and ss. TFEU declining the principles of territorial cohesion policy and their implementation, the interpretation made by the EU Court of Justice, the contributions made by the resolutions adopted by the European Parliament (the last of 2022), the European Committee of the Regions, the European Economic and Social Committee and the Conference of Peripheral Maritime Regions.
Titolo: Le prospettive dell’insularità nell’ordinamento europeo
Abstract [It]: L’ordinamento europeo dedica specifiche previsioni alla condizione di insularità sia per quanto concerne lo speciale regime delle Regioni ultraperiferiche (349 e 355 TFUE, tutte insulari tranne la Guyana francese), ma anche per le regioni insulari europee. Una crescente considerazione che si connette ai percorsi di costituzionalizzazione in atto (in Italia, che ha introdotto il sesto comma dell’articolo. 119 Cost., che si ricollega a quelli già definiti in Spagna e Portogallo, ed al percorso avviato in Francia con la proposta elaborata dalla Corsica). Lo studio intende analizzare l’evoluzione che ha riguardato nel diritto europeo sino alle previsioni degli artt. 174 e ss. TFUE che declinano i principi della politica di coesione territoriale e la loro attuazione, l’interpretazione che ne ha fatto la Corte di giustizia UE, i contributi offerti dalle risoluzioni approvate dal Parlamento europeo (l’ultima del 2022), dai molteplici pareri resi dal Comitato europeo delle Regioni, dal Comitato economico e sociale europeo dell’Unione e dalla Conferenza delle Regioni Periferiche Marittime.
