Abstract [It]: Il presente contributo si occupa del tema della lotta allo spreco alimentare nel contesto dell’Unione Europea con particolare attenzione alle recenti iniziative legislative volte ad introdurre, nell’ordinamento italiano, la pratica della doggy bag. Operata una premessa sulla portata del fenomeno dello spreco alimentare ed analizzati i dati allo stesso afferenti, si traccerà il quadro normativo entro il quale le proposte di legge A.S. n. 972, A. C. 1638 e A. C. 1643 si ascrivono. Al fine di comprendere le modalità attraverso le quali lo spreco alimentare può essere arginato, si analizzerà inoltre la vigente normativa francese. Nelle brevi note conclusive, si tornerà all’ordinamento italiano e si opereranno alcune riflessioni sull’opportunità che la pratica della doggy bag sia disciplinata ex lege.
Title: Virtuous practices against food waste in Italy: reflections on the recent proposed law on the so-called doggy bag
Abstract [En]: This paper addresses the issue of combating food waste within the European Union, with
particular focus on recent legislative initiatives aimed at introducing the practice of the ‘doggy bag’ into the Italian legal framework. An outline on the food waste phenomenon will be given, along with an analysis of the related data and the regulatory context in which the legislative proposals A. S. n. 972, A.C. 1638 and A.C. 1643 were formulated. To further explore the mechanisms through which food waste can be mitigated, the existing French legislation will also be examined. In the concluding remarks, the focus will return to the Italian legal system, where considerations on the appropriateness of regulating the doggy bag practice through statutory law will be presented.
