 «L’irrinunciabile diritto» alla protezione umanitaria in Sudafrica.

Abstract [It]: Il diritto d’asilo è un diritto fondamentale irrinunciabile? Nel caso in esame, la High Court of South Africa risponde positivamente a questo interrogativo, affermando l’esistenza di una absolute protection, in particolare laddove sia possibile provare l'esistenza di una minaccia concreta per il soggetto richiedente.

 

Title: “The inalienable right” to humanitarian protection in South Africa.

Abstract [En]: Is the right of asylum an inalienable fundamental right? In the present case, the High Court of South Africa answers positively to this question, by affirming the existence of an absolute protection, especially where it is possible to prove the existence of a concrete threat to the applicant.
