Tra coordinamento informativo e livelli essenziali delle prestazioni: il caso del Fascicolo Sanitario Elettronico

Abstract [It]: Le recenti Linee Guida per l’attuazione del Fascicolo Sanitario Elettronico (FSE), adottate con decreto del ministro della salute del 20 maggio 2022 previo parere della Conferenza permanente per i rapporti tra lo Stato e le regioni, sono finalizzate alla implementazione dei requisiti tecnici volti a consentire l’interoperabilità dei FSE regionali. In realtà, dietro il “velo” delle specifiche tecniche si celano scelte politiche e valoriali che, in quanto tali, coinvolgono sia un certo “livello” di realizzazione delle prestazioni che un certo “livello” di collaborazione tra Stato e regioni. Per questo, quando il decreto si limita a richiamare, a suo fondamento, il coordinamento informativo ex art. 117, c. 2, lett. r), Cost., sminuisce il ruolo assolto dal FSE, in un duplice senso. Sia per la sua essenziale strumentalità rispetto alla piena realizzazione del diritto fondamentale alla salute, che per il grado di collaborazione che si sarebbe dovuto conseguentemente instaurare tra lo Stato e le autonomie territoriali, secondo quanto richiesto dalla giurisprudenza costituzionale e dall’impostazione legislativa in materia di LEP.

Title: Between information coordination and essential performance levels: the case of the Electronic Health Record

Abstract [En]: The recent Guidelines for the Electronic Health Dossier (FSE), adopted by Decree of the Minister of Health on May 20^th, 2022 upon the advice of the Standing Conference on relations between the State and the regions, regulate aspects of a strictly technical nature, aimed at the full implementation of the interoperability of the regional FSE. Actually, behind the “veil” of technical specifications, political and value choices lie. They involve both, a certain “level” of services and a certain “level” of collaboration between State and regions. For this reason, the reference to the state exclusive competence in information coordination, pursuant to art. 117, par. 2, lett. r), Cost., as the Decree does, not only downsizes the essential contribution of the FSE to the full implementation of the fundamental right to health, but also the implied degree of the cooperation between the State and the territorial autonomies that, in compliance with the trend of the constitutional case-law and the legislative approach to LEP, would have been required.
