 The political and institutional responsibility of the Armed Forces and the National Police before the President of the Republic: the case of the Republic of Angola

Abstract [En]: This paper intends to analyze the political and institutional relationship between the Armed Forces, the National Police and the President of the Republic in order to understand the limits of responsibility, subordination and hierarchy in the constitutional context of the Republic of Angola. To do so, the research establishes, firstly, the institutional, political and corporate tensions between the Armed Forces and the democratic regimes that substituted military governments and, secondly, the foundations of Judgment n. 796/2023, of the Constitutional Court of Angola, which defines the supreme authority of the President of the Republic, regardless of the intermediary in the chain of command for assigning orders as a constitutional imperative. For the purposes of its investigation, this paper considers both the historical process of democratization of Angolan institutions and the context of existing tension at constitutional levels for determining the place of the Armed Forces in societies of low density and fragile democratic perennialism, which is shown to be common in Lusophone countries. With a view to reaching the scientific objective, the research was built under the inductive method.

Abstract [It]: Questo scritto intende analizzare le intercconnessioni politiche e istituzionali tra il Presidente della Repubblica, le Forze Armate e le Forze di polizia, per comporendere i limiti alla responsabilità, subordinazione e gerarchie nella Repubblica di Angola. Prima di tutto vengono evidenziate le tensioni istituzionali e politiche tra le Forze Armate e i regimi democratici che hanno sostituito i governi guidati dai militari; in secondo luogo, i fondamenti del Giudizio n. 796/2023 della Corte costituzionale angolana, che definisce il ruolo del Presidente della Repubblica indipendentemente dal ruolo di intermediario che a livello costituzionale. Ai fini della sua indagine, il presente contributo considera sia il processo storico di democratizzazione delle istituzioni angolane sia il contesto di tensione esistente a livello costituzionale per comprendere il ruolo delle Forze Armate in un contesto di debolezza delle istituzioni democratiche, che si dimostra essere comune nei paesi lusofoni. Al fine di raggiungere l'obiettivo scientifico, la ricerca è stata costruita secondo il metodo induttivo.
