 La protección interamericana de derechos humanos en el contexto de un diálogo global

Resumen: Este estudio tiene por objeto realizar un acercamiento al fenómeno del diálogo entre jueces. En particular, en este caso, nos concentraremos en el diálogo interactivo que se plantea entre la Corte Interamericana de Derechos Humanos (en adelante, la Corte IDH) y los tribunales nacionales. El diálogo entre jueces en materia de derechos humanos se ha planteado junto con el control de convencionalidad. Esta és una doctrina desarrollada por la Corte Interamericana de Derechos Humanos según la qual es un deber de los Estados que han suscrito y ratificado la Convención Americana sobre Derechos Humanos (CADH) darle debido cumplimiento y que esta obligación se extiende a todos los órganos del Estado. Uno de los hallazgos más relevantes que este articulo destaca es que la dinámica que se produce a través del actual diálogo entre jueces, especialmente en el ámbito de la protección de los derechos fundamentales, es creciente, de carácter multinivel y también multimodal.

 

Abstract : This paper aims to make an approach to the phenomenon of dialogue between courts. In particular, in this case, we focus on the interactive dialogue that arises between the Inter-American Court of Human Rights (hereinafter the Court) and national courts. The dialogue between judges on human rights has been raised with the conventionality control. This is a doctrine developed by the Inter-American Court of Human Rights according to which the States partners of the American Convention on Human Rights (ACHR) have the due to enforce their human rights obligations through all organs of the State. One of the most important arguments of this article is to highlight how the dynamics that occurs through the ongoing dialogue between judges, have been increasing the protection of fundamental rights in a multilevel and multimodal manner.
