La basic structure doctrine approda in Africa. La Corte d'Appello del Lesotho e gli emendamenti costituzionali incostituzionali

Abstract [It]: Questo saggio indaga, muovendo dalla recentissima giurisprudenza della Corte d’Appello del Lesotho, in tema emendamenti costituzionali incostituzionali, la circolazione della basic structure doctrine assieme alla forma di governo parlamentare nel Commonwealth britannico. La Corte d’Appello del Lesotho, nel sancire l’incostituzionalità di alcuni emendamenti costituzionali che avrebbero avuto un moderato impatto sul Westminster model, ha fatto ricorso per la prima volta alla basic structure doctrine elaborata dalla Corte Suprema indiana. Così, il contributo analizzerà il giudizio della corte di vertice del Lesotho in comparazione con la giurisprudenza di quelle corti dell’Africa Subsahariana che non hanno ritenuto necessaria l’applicazione della basic structure; le conclusioni della Corte d’Appello, però, non sembrano convincere e i diversi vulnera verranno evidenziati nelle conclusioni, anche considerando la dissenting opinion. 

Title: The basic structure doctrine lands in Africa. The Lesotho Court of Appeal and the unconstitutional constitutional amendments.

Abstract [En]: This essay investigates, through the recent jurisprudence of the Lesotho Court of Appeal, the unconstitutional constitutional amendments, the cross-fertilization of the basic structure doctrine and the circulation of the Westminster model in the British Commonwealth. The Lesotho Court of Appeal, by assessing the unconstitutionality of the 9^th Amendment Act, which would have only minimum consequences over the parliamentary form of government, grounded its judgement over the basic structure doctrine of the Indian Supreme Court. Therefore, in the essay a comparison with other judgments of African apex courts where the basic structure was not applied will be offered and the reasoning of the Court of Appeal of Lesotho will be critically evaluated, taking into consideration the valuable argumentation of the dissenting opinion.
