 What went wrong? Una (ri)discussione sulla garanzia dei matrimoni same-sex nel contesto costituzionale namibiano.

Abstract [It]: Lo scorso gennaio, la High Court di Windhoek ha ripensato lo status dei diritti LGBT+ in Namibia. I casi Digashu and Seiler-Lilles v Government of the Republic of Namibia riguardano, segnatamente, due coppie same sex formate da cittadini namibiani e stranieri. I ricorrenti sostengono di essere stati discriminati come “coniugi” dalle autorità competenti in materia di immigrazione. L’interpretazione e il ragionamento “trasformativi” della High Court, tuttavia, dovranno confrontarsi con il leading case Chairperson of the Immigration Selection Board, deciso dalla Corte Suprema nel 2001.

 

Title: What went wrong? New and old debates over same-sex marriages in the Namibian constitutional framework.

Abstract [En]: Last January, the High Court of Windhoek disputed the LGBT+ rights status in Namibia. The Digashu and Seiler-Lilles v Government of the Republic of Namibia cases concern two Namibian citizens in a same-sex marriage with non-citizens. The applicants claimed they were discriminated against as ‘spouses’ by the domestic immigration authorities. The High Court’s ‘transformative’ interpretation and reasoning are nonetheless challenged by the leading case Chairperson of the Immigration Selection Board ruled by the Supreme Court in 2001.
