La disciplina della libertà di espressione e dell’hate speech in Sudafrica: l'eredità di una storia (nazionale) complessa.

Abstract [It]: Attraverso il commento della sentenza della Corte costituzionale del Sudafrica “South African Human Rights Commission on behalf of South African Jewish Board of Deputies v. Bongani Masuku et al.” lo scritto esamina la regolamentazione della libertà di espressione e dell’hate speech nell’ordinamento sudafricano e ne esplora le problematiche. La ricostruzione del quadro normativo, unitamente ai richiami giurisprudenziali, consentirà di evidenziare il forte legame tra la disciplina della libertà di espressione in Sudafrica e la volontà di marcare un segno di discontinuità rispetto all’esperienza dell’apartheid.

Title: The regulation of the freedom of expression and hate speech in South Africa: the legacy of a complex (national) history. Some remarks from a recent judgement of the Constitutional Court.

Abstract [En]: Through the comment of the decision of the Constitutional Court of South Africa “South African Human Rights Commission on behalf of South African Jewish Board of Deputies v. Bongani Masuku et al.” this paper examines the regulation of the freedom of expression and hate speech in the South African legal system and explores its challenges. The reconstruction of the regulatory framework, together with the jurisprudential references, will make it possible to highlight the strong link between the regulation of the freedom of expression in South Africa and the desire to mark a discontinuity with the apartheid system.
