Abstract [It]: Il 24 marzo 2022, la High Court di Malindi ha reso una pronuncia cruciale in materia di diritti riproduttivi in Kenya. Essa è stata adita per una asserita (severa) violazione del diritto all’aborto di una giovane donna. La Corte è chiamata a decidere su temi fondamentali, non solo per la petitioner, ma per tutte le donne “of reproductive age” in Kenya. Deciderà, infine, per la presenza di lacune nella statutory law rispetto alla cornice disegnata dall’articolo 26(4) della Costituzione.
Title: Kenya speaks out about abortion (again): the Malindi High Court rules on rights (violation) and future scenarios.
Abstract [En]: On the 24th of March 2022, the Malindi High Court delivered a crucial ruling on reproductive rights in Kenya. The case related to the alleged (severe) violation of a young woman’s right to abortion. The Court shall rule on fundamental issues, not only concerning the petitioner individually, but for all women of “reproductive age” in Kenya. Eventually, the Court affirmed the statutory law to be inconsistent with the constitutional framework, as per Article 26(4) of the Constitution of Kenya.
