La Corte constata la violazione del diritto dei ricorrenti a un equo processo e a un ricorso effettivo in conseguenza dell’eccessiva durata del procedimento avviato dinanzi al giudice amministrativo con l’impugnazione di un ordine di demolizione di opere edilizie realizzate abusivamente su una costruzione esistente. La Corte ribadisce altresì che la disponibilità di un ricorso effettivo prevista dall’art. 13 CEDU non è soddisfatta dai mezzi di ricorso di cui i ricorrenti si sono potuti avvalere per lamentare l’irragionevole durata del procedimento giudiziario che li riguarda (“legge Pinto”).
