 Il Bill of Rights (bill): la ratio di un progetto di riforma controverso

Abstract [It]: Questo contributo si pone l’obiettivo di descrivere nei suoi contenuti essenziali il progetto di riforma dello Human Rights Act 1998 e la sua sostituzione con un nuovo Bill of Rights. Più nello specifico, si cercheranno di comprendere le possibili ripercussioni del bill sul piano dei rapporti tra l’ordinamento britannico e la Convenzione europea dei diritti dell’uomo, nonché, su quello interno, fra gli organi di cui si compone la forma di governo. Da ultimo, si metterà in luce come ad un livello generale il progetto di legge rappresenti l’estrinsecazione di una chiara idea di costituzionalismo dalla forte matrice politica.

 

Title: The Bill of Rights (bill): the rationale of a controversial reform project

Abstract [En]: This article aims to describe in its essential contents the draft reform of the Human Rights Act 1998 and its replacement with a new Bill of Rights. More specifically, an attempt will be made to understand the possible repercussions of the bill on the level of relations between the British legal system and the European Convention on Human Rights, as well as, on the domestic level, among the institutions of the form of government. Finally, it will be highlighted how on a general level the bill embodies a clear idea of political constitutionalism.
