 Diritto all’autodeterminazione del paziente nelle decisioni fine vita in Europa: riflessioni a margine della sentenza Mortier c. Belgio della Corte Europea dei Diritti dell’Uomo

Abstract [It]: Alla luce della recente sentenza Mortier c. Belgio della Corte Europea dei Diritti Umani, l’articolo prende in considerazione l’evoluzione del diritto di autodeterminazione del paziente nella giurisprudenza CEDU e degli Stati Membri in materia eutanasia e suicidio assistito. La pronuncia contiene spunti interessanti che inducono a riflettere sul ruolo dello stato e del biodiritto nel dibattito contemporaneo, confrontandosi con la possibilità che anche gruppi particolarmente vulnerabili, come i minori o le persone con grave disagio psichico, possano accedere a trattamenti fine vita.

 

Title: The patient’s right to self-determination in end-of-life decisions in Europe: reflections in the margin of the Mortier v. Belgium judgment of the European Court of Human Rights

Abstract [En]:  In light of the recent European Court of Human Rights case Mortier v. Belgium, this article examines the evolution of the patient's right to self-determination in ECHR and member state jurisprudence on euthanasia and assisted suicide. The decision offers insightful reflections about state's and biolaw's roles in the current debate about this topic, considering the possibility that even extremely vulnerable groups, such children or individuals with severe mental suffering, may have access to end-of-life treatment.
