 La tutela della biodiversità: dal diritto internazionale alla Costituzione

Abstract [It]: L’articolo fornisce una ricostruzione della normativa a tutela della biodiversità, a partire dal diritto internazionale ed europeo fino alla recente riforma costituzionale che ha inserito la biodiversità in Costituzione. L’analisi delle più recenti tendenze sul tema fornisce spunto per riflessioni di carattere più generale sul tema del bilanciamento degli interessi ambientali con altri interessi costituzionalmente rilevanti, alla luce dei più recenti orientamenti giurisprudenziali.

 

Title: Protecting biodiversity: from international law to the Constitution

Abstract [En]: The paper provides a reconstruction of the main legislations on the protection of biodiversity, from international law to the recent constitutional reform that has introduced the protection of biodiversity in the Italian Constitution. The analysis of the most recent trends on the subject provides insights for more general reflections about the difficult balance between environmental interests and other constitutionally relevant interests, in the light of the most recent jurisprudential development.
