Abstract [It]: Il presente contributo, dopo un’analisi introduttiva in materia di kafalah come strumento di protezione del minore, si sofferma sull’inquadramento di tale istituto all’interno degli ordinamenti giuridici italiano e francese, senza tralasciare il ruolo centrale ricoperto dalla giurisprudenza sovranazionale. Dalla comparazione, si evidenzia come gli istituti di derivazione religiosa siano influenzati dalla diversa concezione di laicità: la Francia ha preferito intervenire imponendo criteri legislativi per il riconoscimento degli effetti della kafalah, mentre l’Italia ha concesso maggior margine di valutazione al potere giudiziario.
Title: The Kafalah as an instrument of child protection in Italian and French jurisprudence
Abstract [En]: This contribution, after an introductory analysis on kafalah as an instrument of child protection, dwells on the framing of this institution within the Italian and French legal systems, without neglecting the central role played by supranational jurisprudence. This comparative approach shows how religiously derived institutions are influenced by the different concept of secularism: France has preferred to intervene by imposing legislative criteria for the recognition of the effects of the kafalah, while Italy has granted greater scope to the judiciary.
