Abstract [En]: National Courts have assumed a key role in the relations between States, in light of their power to review decisions of the executive with respect to the participation to or the withdrawal from international agreements. This article aims to analyze such involvement on a practical level, taking into account the nature - procedural or substantial - of the scrutiny with a view to underline the possible limits of such phenomenon.
Abstract [It]: Le corti nazionali hanno assunto un ruolo chiave nelle relazioni fra Stati alla luce del loro potere di scrutinio sulle decisioni dell’esecutivo in merito alla partecipazione o al recesso da accordi internazionali. Il presente articolo intende analizzare come tale coinvolgimento si realizza sul piano pratico, tenendo conto della natura - processuale o sostanziale - del controllo effettuato, nell’ottica di evidenziare gli eventuali limiti di questo fenomeno.
