 I poteri normativi del Governo nel Regno d'Italia

Abstract [It]: Il saggio propone una riflessione sui poteri normativi del Governo nel sistema delle fonti del Regno d’Italia al fine di vagliare in quale misura l’avvento della Repubblica abbia rappresentato una rottura rispetto alla continuità del periodo precedente. In questa prospettiva, dopo un inquadramento generale dell’assetto delle fonti del Regno d’Italia, il saggio analizza il rapporto tra potere normativo del governo e legislazione fascista, con particolare riferimento al rapporto tra la legge n.100 del 1926 e la disciplina dei decreti legislativi, dei decreti legge e del potere regolamentare del Governo. Infine, il contributo tratta del rapporto tra potere normativo del governo e diritto coloniale. 

 

Abstract [En]: The essay proposes a reflection on the legislative power of the Italian government within the framework of the Kingdom of Italy in order to assess to what extent the advent of the Republic represented a break to the continuity characterising the statutory period. In this perspective, after a general overview of the structure of the sources of the Kingdom of Italy, the essay analyses the relationship between the power of the government and the fascist legislation, with particular reference to the connections between law n. 100 of 1926 and the discipline of the Legislative decree, the Decree-Law and the Government regulation’s power. Finally, the contribution deals with the relationship between the legislative power of the government and the colonial law.
