Abstract [En]: The purpose of this essay is to shed light on the constitutional relevance of Brexit in light of the European federalising process. The first part deals with the European Union framework on withdrawal and how it has been a constitutional moment for the EU. The second part highlights the fact that the relationship between secession and constitutional law has often been considered a “tabù”. Nevertheless, there are examples in comparative law, especially from federal countries, which have incorporated the right to secession. This essay concludes that the EU has added a valuable example to secession and comparative law. In fact, despite through extremely difficult negotiations, it has been a successful example in regulating secession and it may be considered the “practice” of what the Supreme Court of Canada has taught.
Abstract [It]: Questo saggio mira ad evidenziare la rilevanza costitutionale della c.d. “Brexit” alla luce del federalising process europeo. La prima parte riguarda la procedura accolta dai Trattati europei in materia di recesso e perdita della membership europea e come ciò sia stato un “momento” costitutionale per l’UE. La seconda parte del saggio ricorda che il diritto a secedere sia sempre stato inteso come un “tabù” nel diritto costitutionale. A fronte di ciò, non mancano esempi nel diritto comparato, soprattutto tra gli Stati federali, che hanno incorporato siffatto diritto. Nell’ultima parte del saggio vi si afferma che l’Unione europea abbia aggiunto un valido esempio nella prassi del diritto a secedere. Infatti, a fronte di negoziazioni estremamente difficili, visti i numerosissimi nodi giuridici da sciogliere, l’esperienza europea in materia di secessione o withdrawal è considerabile la migliore “prassi” rispetto agli insegnamenti della Corte Suprema del Canada.
