Abstract [It]: Qual è il rapporto tra la tecnica e l’eguaglianza? Come proteggere le libertà individuali dalle aggressioni del potere pubblico e dagli abusi delle Autorità private? Il saggio si interroga su tre principali issue: 1) come assicurare a tutti l’eguaglianza formale nei diritti, in particolare, quelli neuronali? Il caso di studio è il neuroimaging, tecnica che per la sua capacità di leggere nel foro interno può fornire utili strumenti probatori, non immuni però da dubbi di compatibilità costituzionale con i principi supremi in materia. Se poi queste prove venissero sollevate da dai sospetti di illegittimità, andrebbero assicurate anche a chi non potrebbe permettersele? 2) La pretesa all’eguaglianza formale è sufficiente a rendere equi e competitivi i mercati caratterizzati da situazioni di dominanza a favore di pochi detentori delle leve del progresso tecnico? A tal proposito sono state analizzate in comparazione le normative asimmetriche di tre settori (telecomunicazioni, mercato digitale, l’informazione online) che hanno l’obiettivo di equiordinare gli imprenditori, titolari di asset o di Big data, a chi invece ne è privo in vista del bene ultimo: moltiplicare le offerte di prestazioni e beni virtuali per il cittadino, destinatario finale della disciplina asimmetrica. 3) La normativa asimmetrica è il solo modello regolatorio in grado di rimuovere gli ostacoli ai neurodiritti e alla dignità costituzionale della persona o sono ipotizzabili scenari diversi?
Title: New technology for new inequalities. Case law: Telecommunications Regulation, Digital Services Act and Neurorights
Abstract [En]: What is the relationship between technique and equality? How to protect individual freedoms from the aggression of public power and the abuses of private authorities? The essay questions three main issues: 1) how to ensure formal equality in rights for all, in particular neuronal rights? The case study is neuroimaging, a technique which, due to its ability to read the internal forum, can provide useful evidentiary tools, but is not immune from doubts of constitutional compatibility with the supreme principles on the matter. If these tests were then raised by suspicions of illegitimacy, should they also be insured for those who could not afford them? 2) Is the claim to formal equality sufficient to make markets characterized by situations of dominance in favor of a few holders of the levers of technical progress fair and competitive? In this regard, the asymmetric regulations of three sectors (telecommunications, digital market, online information) were analyzed in comparison, which have the objective of equalizing entrepreneurs, owners of assets or Big data, with those who do not have them in view of the ultimate good: multiply the offers of services and virtual goods for the citizen, the final recipient of the asymmetric discipline. 3) Is asymmetric legislation the only regulatory model capable of removing obstacles to neurorights and the constitutional dignity of the person or are different scenarios conceivable?
