 Il Governo francese nell’ordinamento della V Repubblica: tra continuità e discontinuità

Abstract [It]: In un momento in cui la crisi sanitaria sottopone l’ordinamento francese ad uno “stress test”, appare utile tornare a riflettere sull’ampiezza delle responsabilità del Primo Ministro e del Governo nell’ordinamento della V Repubblica. Le disposizioni costituzionali sulle prerogative del Governo, l’evoluzione del sistema delle fonti, il rapporto tra potere politico e amministrativo dimostrano l’intenso ruolo politico e amministrativo esercitato dal Primo Ministro (e dal Governo) nell’attuazione dell’indirizzo politico presidenziale.

 

Abstract [En]: At a time when the health crisis is subjecting the French legal system to a "stress test", it seems useful to reflect on the extent of the responsibilities of the Prime Minister and the Government in the legal system of the Fifth Republic. The constitutional provisions on the prerogatives of the Government, the evolution of the system of sources, the relationship between political and administrative power show the intense political and administrative role played by the Prime Minister (and by the Government) in the implementation of the presidential policy.
