Abstract [En]: The status quo of extremely concentrated social media markets, where a handful of platforms control the vast majority of the flow of information in our society, has led to questioning whether the users can claim that the platforms have a duty to keep up the content they upload. This article assesses whether such claims can be based on existing EU law, and explores the challenges that this duty would raise with regards to the legal interest to be protected, and the kind of content and activities that would fall into its scope.
Abstract [It]: Lo status quo rappresentato da mercati per i servizi di social network estremamente concentrati, dove un numero ristretto di piattaforme controlla il flusso di informazioni nella nostra società ha fatto sorgere pretese relative a un supposto obbligo, in capo a tali piattaforme, di mantenere online il contenuto caricato dagli utenti. Il contributo si propone di verificare se esiste, nel diritto dell’Unione Europea ad oggi vigente, un’adeguata base legale per tale obbligo ed esplora le problematiche che da quest’ultimo deriverebbero con riferimento all’interesse giuridico protetto e al contenuto ed alle attività da ricomprendere nell’ambito dell’obbligo stesso.
