Una promessa incompiuta il piano nazionale di ripresa e resilienza?

Abstract [It]: L’Autrice propone una lettura su due colonne: in una il Recovery europeo, nell’altra il piano dell’Esecutivo Draghi. Si pone tre domande basilari, intorno alle quali articola il suo percorso logico-pragmatico. L’ulteriore conformazione della potestà sovrana per l’inversione a U della politica europea – prima preoccupata di contenere la spesa pubblica, ora di promuoverla secondo le rime della solidarietà sociale – è ricompensata costituzionalmente da misure di effettiva uguaglianza sostanziale? Il Recovery italiano prevede rimedi asimmetrici in bonam partem a favore delle categorie discriminate – Donne, Giovani e Sud – per allinearle alle più fortunate, ma rimane il dubbio che questo ritorno alla normalità non sia migliore dello status quo ante. La seconda questione è una riflessione, che parte dalla mutata fisionomia dell’indirizzo politico nazionale: parzialmente autonomo dal paradigma originario, ma non già attratto a una diversa categoria giuridica. La sovranità digitale e post pandemica è indifferente all’originario radicamento territoriale e all’imputazione soggettiva pubblica, ma altre certezze non sembra avere. Infine, la domanda sul futuro dei nostri figli, che è anche la domanda sul futuro dell’Europa. Oggi tutto sembra cambiare per avere domani un’Europa diversa. Ma quale Europa: quella che difende i diritti sociali con l’effettività della forza del diritto o quella che li promette senza assisterli?

Abstract [En]: The Author proposes a reading in two columns: in one the European Recovery, in the other Draghi's National plan. She develops her logic-pragmatic argument around three basic questions. The first arises out of the “U” inversion of the European politics, whose major concern was once to restrain public expenditure and which aims now to promote it pursuing social solidarity goals. Is this new direction actually carrying an effective constitutional advancement of substantive equality? The review of the Italian Recovery aims to respond to this question through an accurate analysis of the asymmetric measures adopted by such act in favour of the three traditionally discriminated categories – Women, Young People, South – in order to align them to the more rewarded ones. The assumption being that no one should be left behind, when returning to a more virtuous normality than that previously existing. The second question entails a reflection, moving from the new direction of the national policy: partially autonomous from the original paradigm but not yet amenable to another legal category. The digital and post-pandemic sovereignty is only marked by the irrelevance of a precise territorial link and of the imputation to a specific public authority. Other certainties appear to be missing. The last question concerns the future of our Next Generation, which also applies to the future of Europe. Everything seems to change today in order to to have a different Europe tomorrow. But which Europe will it be: the one which defends social rights effectively by resorting to legal enforcement tools or the one which promises to implement such rights without properly supporting them?
