Abstract [It]: L'articolo approfondisce la questione del risarcimento dei danni morali alla Corte di Strasburgo, in particolare nel caso in cui la parte ricorrente non ne abbia quantificato l'ammontare. Lo spunto è fornito da un caso concreto (Nagmetov v. Russia, G.C., 30 marzo 2017), che serve all'Autore per esporre riflessioni su diverse tematiche: il rispetto del principio del "ne ultra petitum", la ragionevole durata del procedimento, la tenuta dei precedenti, il rispetto delle rules che governano la Corte e la certezza del diritto.
Abstract [En]: The paper examines the issue of compensantion for moral damage in the European Court of Human Rights case-law, especially when the applicant has not quantified the amount. The starting point is provided by the Nagmetov case (Nagmetov vs Russia, G.C., 30 March 2017). The Author reflects on varios issues, as the "ne ultra petitum" principle, the duration of the proceedings, the value of well-established case law, the rules of the Court, and the legal certainty.
