 La libertà nella manifestazione del consenso informato a seguito dell’introduzione della Certificazione verde rafforzata

Abstract [It]: Partendo da un excursus circa le fonti sovranazionali, costituzionali e primarie fondanti il principio del consenso informato, il paper si soffermerà sulla legittimità dell’introduzione della certificazione verde Covid19 c.d. rafforzata. Nel dettaglio, verrà valutata la legittimità di quest’ultima in assenza di una previsione di obbligo vaccinale anti-SARS-CoV-2 (Covid-19) generalizzato. Dato l’ampio impatto di tale tipologia di certificazione nella vita e nei diritti dei consociati, l’analisi investirà altresì il rapporto tra la certificazione verde Covid19 c.d. rafforzata e i principi del consenso informato e dell’autodeterminazione terapeutica.

 

Title: The freedom element in the consent to a medical treatment after the introduction of the reinforced Covid certificate

Abstract [En]: Starting from an excursus on the international, constitutional and primary laws founding the principle of informed consent, the paper will focus on the lawfulness of the introduction of the so-called reinforced Covid19 certificate. In detail, the legitimacy of the latter will be assessed with reference to the absence of a generalized mandatory anti-SARS-CoV-2 (Covid-19) vaccination. Given the broad impact this certification may have on the life and rights of citizens, the analysis will be also extended to the relationship between the so-called reinforced Covid19 certificate and the principles of informed consent and self-determination theory in health-care
