 Corte EDU e tutela del rapporto con il genitore “d’intenzione” nelle coppie dello stesso sesso

Abstract [It]: Il contributo, ricostruendo il dibattito dottrinale e giurisprudenziale sviluppatosi in tema di omogenitorialità, materia non disciplinata dalla legge n. 76 del 2016, indugia sul ruolo svolto dalle Corti, ed in particolare dalla Corte Edu, nella tutela del rapporto del minore con il genitore affettivo nelle coppie dello stesso sesso.

 

Title: The European Court of Human Rights and the protection of the relationship with the 'intended' parent in same-sex couples

Abstract [En]: The contribution, reconstructing the doctrinal and jurisprudential debate that developed on the subject of same-sex parenting, a matter not regulated by law n. 76 of 2016, lingers on the role played by the Courts, and in particular by the Edu Court, in protecting the relationship of the minor with the emotional parent in same-sex couples.
