 Le linee guida tra forma e sostanza. Il sistema delle fonti nel vortice dell’emergenza pandemica

Abstract [It]: L'A. analizza la commistione fra norme obbligatorie e raccomandazioni, fenomeno che ha visto il suo acme di complessità durante l'emergenza pandemica, sondando la rispondenza del sistema delle fonti del diritto alla rapidità dei mutamenti sociali. In particolare, vengono evidenziate le conseguenze che la dinamica del sistema delle fonti produce sulle strutture fondamentali dello Stato costituzionale, tra cui la tutela dei diritti, intimamente legata alla preservazione di un sufficientemente adeguato grado di "certezza giuridica".

 

Title: Guidelines between form and substance. The source system in the maelstrom of the pandemic emergency

Abstract [En]: The A. analyses the mix between mandatory standards and recommendations, a phenomenon that has seen its acme of complexity during the pandemic emergency, probing the responsiveness of the system of sources of the right to rapid social change. In particular, highlighting the consequences that the dynamics of the source system has on the fundamental structures of the constitutional State, including the protection of rights, intimately linked to the preservation of a sufficiently adequate degree of "legal certainty".
